Mileage Reimbursement Rate for Business Use of Personal Vehicle
 
The mileage rate an employer may reimburse an employee for business use of a personal vehicle has increased from 54.5 to 58 cents per mile in 2019.  The mileage allowance is intended to cover fuel, taxes, depreciation, insurance, and maintenance associated with operating a personal vehicle for business purposes.
The 2019 rate for miles driven for medical or moving purposes is 20 cents and 14 cents per mile for miles driven in service of charitable organizations.
Training and Verification Requirements for OSHA  Crane Rule Take Effect on February 7

The training and verification requirements as part of amendments to the OSHA Crane Rule take effect on February 7. Companies with crane operators not subject to the material delivery exemption must evaluate and document their training procedures. As a reminder, crane operators not covered by the material delivery exemption are now required to be certified as of December 9, 2018.

OSHA's revisions to the rule are intended to clarify an employer's responsibility to ensure that a crane operator can operate the equipment safely. It is important to note that the updates assume employers already provide training and evaluation for their crane operators. The training and verification amendments focus particularly on ensuring that operators are trained and evaluated on the specific type, make, and model of crane and specific tasks to be undertaken on the job.

Previously, OSHA viewed operator certification as sufficient for demonstrating competency. However, many employers pointed out that certification essentially functioned as a "learner's permit" and did not demonstrate that an operator was competent on the delivery of specific loads and materials.

Emphasizing training and verification acknowledges that employers are in the best position to evaluate an operator's competency. Employers have some flexibility in determining the level of knowledge and experience that the trainer must possess based on the skill level of the operator-in-training and the nature of the activity performed. Employers are required that each operator demonstrate skills, knowledge, and judgment required for safely completing a particular assignment on a particular crane.

The new requirements serve as best practices for training crane operators. Even for companies covered by the material delivery exemption, training and verification is an important part of determining operator competency.

FMCSA to Allow States to Issue One-Year Commercial Learner's Permits

The Federal Motor Carrier Safety Administration (FMCSA) will soon allow states to issue commercial learner's permits (CLP) for up to one year instead of the current six-month limit with the option to renew the permit for another six months. The new rule is not a requirement for states, but is an option instead of the six-month CLP. If states issue a CLP for less than one year, the CLP may be renewed at the state's discretion, but if it is renewed, the permit can only be valid for a total of one year from the original issue date. After one year from the original issue date, a CLP or renewed CLP will no longer be valid. If a CLP holder does not obtain their CDL within the year before the permit expires, the driver would then be required to reapply for the permit.
