 Shining a Light on BMSA
Did you know that BMSA has a  Safety Hotline?
In addition to providing safety audits, training and our newly updated safety manual, BMSA has put in place a  Safety Hotline . The hotline can be used by anyone, whether you’re the CEO, General Manager, Forklift Operator or Truck Driver. If you are confused about anything related to safety or OSHA regulations, pick up the phone and call  (800) 849-1503  and select  Option #1.  If you’re calling during regular business hours, that call will be answered directly. Your call can be anonymous and you should feel free to ask any question or to even question something you’ve been told by others.

If there’s a topic you’ve been wondering about but don’t have the time to research it yourself, just call. We will work together to get the answers you need and to help ensure that you are compliant with the ever-changing regulations.
FMCSA Raises Random Drug Testing Rate to 50% for 2020
Beginning Jan. 1, 2020, the minimum annual percentage rate for random drug testing will be raised to 50% of the average number of driving positions, according to the Federal Motor Carrier Safety Administration (FMCSA). The minimum annual percentage rate for random alcohol testing will remain at 10%. Further, FMCSA-regulated employers must ensure compliance with the FMCSA Clearinghouse requirements beginning Jan. 6, 2020. This means employers must query the Clearinghouse before allowing a newly-hired commercial motor vehicle driver, or a current employee who transfers into such a position, to begin operating a commercial motor vehicle; query the Clearinghouse at least once per year for each driver they currently employ; report drivers' drug and alcohol program violations to the Clearinghouse within three business days after learning of the information; prohibit drivers who have violated FMCSA's drug and alcohol program regulations from performing safety-sensitive duties unless the driver has complied with the return-to-duty process; and add language to their FMCSA drug and alcohol testing policies to notify drivers and driver applicants of the information that will be reported to the Clearinghouse.

FMCSA Drug Clearinghouse Goes Live, Experiences Connectivity Issues
The Federal Motor Carrier Safety Administration's (FMCSA) Drug and Alcohol Clearinghouse, a database containing information on commercial driver license (CDL) holders' drug and alcohol violations, went live on Jan. 6, but people trying to access it received error messages and sluggish loading times. Carriers, state driver licensing agencies, and law enforcement officials use the clearinghouse to check a CDL holder's drug and alcohol violations. FMCSA has placed a notice on the Clearinghouse website advising employers who are experiencing technical difficulties accessing the database to follow the procedures set forth in section 391.23(e) in title 49 of the Code of Federal Regulations. This section details investigations that employers must conduct for prospective drivers, including those that screen for drug and alcohol violations. The agency is working to resolve the connectivity issues with the clearinghouse.
