FMCSA's New Hours of Service Rules to Go into Effect in September
The Federal Motor Carrier Safety Administration (FMCSA) said its Hours of Service (HOS) rules are on course to go into effect in late September. The FMCSA's Hours of Service Final Rule was slated for publication in the Federal Register on June 1 and is set to take effect 120 days after that publication date. This would set the effective date for the new HOS rule on Sept. 28. The three-month implementation delay will give ELD providers time to update their technology to accommodate the rule changes. There are four key changes to HOS regulations. The FMCSA will increase safety and flexibility for the 30-minute break rule by requiring a break after eight hours of consecutive driving and allowing the break to be satisfied by a driver using on-duty, not driving status, rather than off-duty status. Additionally, it will modify the sleeper-berth exception to allow drivers to split their required 10 hours off duty into two periods: an 8/2 split, or a 7/3 split — with neither period counting against the driver's 14-hour driving window. The agency will modify the adverse driving conditions exception by extending by two hours the maximum window during which driving is permitted. FMCSA also will modify the short-haul exception available to certain commercial drivers by lengthening the drivers' maximum on-duty period from 12 to 14 hours and extending the distance limit within which the driver may operate from 100 to 150 air miles. The agency says the changes are designed to give truckers increased flexibility while preserving highway safety.

NLBMDA Applauds Signing of Paycheck Protection Program Flexibility Act
The National Lumber and Building Material Dealers Association (NLBMDA) issued the following statement after President Trump signed the Paycheck Protection Program Flexibility Act into law. This NLBMDA-backed legislation will ensure additional flexibility for small businesses that utilize the Paycheck Protection Program (PPP).
“NLBMDA is pleased that the White House and both parties in Congress came together to pass significant improvements to the Paycheck Protection Program,” said Jonathan Paine, NLBMDA President & CEO. “NLBMDA has been making the case that these changes are crucial for LBM dealers and this win will ensure greater flexibility for small businesses that utilize the PPP. NLBMDA will continue to press Congress to pass a Phase 4 relief package that fully reflects the priorities of the lumber and building material industry.”
Summary of the Paycheck Protection Program Flexibility Act:
- Allows forgiveness for expenses beyond the 8-week covered period to 24 weeks.
- Employers can continue to apply for a PPP Loan through June 30, 2020. New PPP borrowers will have a 24-week covered period, but they can’t extend beyond December 31, 2020.
- Increases the current limitation on non-payroll expenses (such as rent, utility payments and mortgage interest) for loan forgiveness from 25 to 40 percent.
- Lengthens the loan maturity date from 2 to 5 years.
- Ensures full access to payroll tax deferment for businesses that take PPP loans.
- Extends the loan forgiveness rehire date to December 31, 2020 to ensure small businesses won’t be penalized by high unemployment benefits.
- Creates a safe harbor for businesses that make a good-faith effort to hire or re-hire qualified employees.
- Allows borrowers who received PPP loans prior to enactment to choose for the covered period of their loan to either last 8 weeks or 24 weeks from origination.

Professional Builders Supply acquired a majority interest in Charlotte, N.C.-based SouthEnd Exteriors. SouthEnd provides turnkey siding and roofing installations to single-family residential builders throughout the Carolinas and Nashville, Tenn. SouthEnd generated an approximate $100 million in annualized revenues, according to PBS. Jamie Oliver and Ryan Roberts, the owners of SouthEnd, will continue to lead and manage the operation under the SouthEnd Exteriors brand name after the acquisition. PBS CEO Van Isley said the culture and core values at SouthEnd and PBS align “extremely well.” Isley said SouthEnd’s footprint in the south provides expansion opportunities for PBS’ core business. Raleigh, N.C.-based PBS ranked 20th on the 2020 ProSales 100 and generated $315.9 million in revenue in 2019. PBS sells and distributes building materials out of 10 facilities in North Carolina, South Carolina, and Georgia.
